As it became known "to Crime. Is NOT PRESENT", yesterday, on April 21, the Nikolaev appellate court made the decision on extension of term of detention of the chairman of the Nikolaev Economic court Yury Koval who was detained when receiving a bribe in November, 2007, till 6 months.
We will remind, Yu.Koval was detained on November 16, 2007 in own office by employees of Public service on fight against economic crimes. They withdrew about 5 thousand dollars from the judge and released on recognizance. Then charges according to p.1 Art. 364 ("The abuse of power which has entailed heavy consequences") and were brought to Yu.Koval h. 2 Art. 368 of UK ("Receiving a bribe in especially large size").
The decision on excitement concerning Yu.Koval of criminal case was made by Pechersky regional court of Kiev on November 15, 2007. However on February 6 this year. The appellate court of Kiev cancelled this decision "in connection with insufficient evidential base". Nevertheless, GPU continued investigation.
On December 18, 2008 the Verkhovna Rada agreed to arrest (a capture under guards) the judge of a local economic court of the Nikolaev area Yury Koval. 396 deputies voted for the draft of the resolution No. 3500 from 441 present at halls. And already on December 23, directly in a hall of Pechersky court of the city of Kiev the chairman of the Nikolaev regional economic court Yury Koval was arrested. Then the decision on its capture under guards for 2 months was made. It will be delivered in the Nikolaev pre-trial detention center No. 20.
At present Nikolaev was left already by police officers who will accompany Yury Mikhaylovich in a pre-trial detention center.
On the expiration of this term, during a yesterday's court session protection insisted on that recognizance not to leave was chosen a measure of restraint. However, having taken into account arguments of the party of charge that Yu. Koval can affect a consequence, the court left a former measure of restraint - "detention".
Representatives of the Prosecutor General's Office of Ukraine took part in this meeting also.
