As it is reported on the official site to the Authorized Verkhovna Rada on human rights of Valeria Lutkovskaya, after a meeting of the regional coordinator of interaction with the public of an omubdsmen in area in interests of the arrested production was open.
«When considering the case it was established that were cancelled by the resolution of court of cassation of February 10 of the current year a sentence of Factory district court of Nikolaev of October 25, 2013 and definition of appellate court of the Nikolaev area of March 5, 2014, and business is sent for new judicial review in court of the first instance. Thus, the court of cassation instance in the specified resolution noted need of a motivated judgment of the first instance of a question of a type of a measure of restraint. At the same time, after receipt of business in court of the first instance the question of extension of term of detention wasn't solved» , it is told in the message.
In this regard the ombudsman came to a conclusion that in that case there is an obvious fact of the illegal maintenance of the man under guards as period of validity of the resolution of the Supreme specialized court of Ukraine on consideration of civil and criminal cases of February 10 ended on April 11, and other judgment about extension of term of the contents it under guards wasn't.
«About it the ombudsman filed on April 27, 2015 a petition for a crime to the Attorney-General of Ukraine and the prosecutor of the Nikolaev area. On the basis of the specified statement of the Representative the corresponding data were brought on May 5 in ERDR of rather illegal detention of the citizen in Nikolaevsk by a pre-trial detention center on signs of the criminal offense provided by part of the second article 371 Criminal Ukraine and the criminal proceedings are opened. However on July 20 the investigator of prosecutor's office of the Nikolaev area issued the decree on closing of the specified production» , - it is noted in the message.
