The Prosecutor General's Office made the decision to withdraw an order of the investigator Dmitry PAVLIYA which provided possibility of implementation quickly - investigation actions concerning any of the Ukrainian judges.

According to the edition, the State Office of Public Prosecutor considered the address concerning the illegal order of the investigator of GPU D. PAVLIYa given by it to the Minister of Internal Affairs, concerning carrying out quickly - investigation actions concerning all judges of Ukraine.
In the document signed by the chief of the Head investigative department of A.HOChUNSKOGO, it is established that on May 20, 2009 the investigator D. PAVLY "in the absence of the sufficient bases provided by the law, gave an assignment to the Minister of Internal Affairs of Ukraine concerning carrying out quickly - search actions for check of possible participation of Melnik N. I. CHERNUSHENKO A.V. and other employees of court to illegal activity of DURDINTSA T.Yu. (ex-the vice-chairman of SBU Tiberiya DURDINTS - the UNIAN) or to other crimes. 03.07.09 from the Ministry of Internal Affairs of Ukraine the investigator withdrew the specified assignment".
For the allowed violations of requirements of the current legislation to the investigator measures of public prosecutor's reaction are taken, is specified in the document.
Thus criminal responsibility doesn't threaten D. PAVLY as the Ministry of Internal Affairs of Ukraine on its assignment quickly - technical actions didn't carry out, the author of the document claims.
"According to information of the Ministry of Internal Affairs of Ukraine, under the specified power of attorney of the investigator quickly - search affairs weren't started, quickly - technical actions weren't carried out, and therefore constitutional rights aren't violated. Under such circumstances the bases for making decision on the investigator from investigation of criminal case aren't seen in an order of Art. 97 of the Criminal Procedure Code of Ukraine and its discharge", is spoken in the document.
