The appellate court of the Crimea rejected appeal complaints of prosecutor's office and injured Alexander Goppe on the case of road accident with participation of the son of the deputy of the Simferopol city council Iosif Fayngold Vitaly.
The lawyer of the victim Valery Yurchenko told that after half-hour court session the appeal board on criminal cases made the decision to uphold a sentence of Railway court of Simferopol. He noted that the court didn't explain, on what basis passed such decision. "Asked couple of questions from a series: why you consider, what if imprisonment will be, will pay moral damage? After that were removed to the consultative room", - the lawyer told.
He added that written justification of a judgment will be handed out to it in the middle of January. After that it will be possible to appeal once again against a judgment, but already in the Supreme Court of Ukraine. At the same time V. Yurchenko noticed that doesn't know, whether the victim will want to have legal proceedings further.
As it was already reported on September 16 last year in Simferopol as a result of collision of the Suzuki motorcycle with the Bentley car I died on the spot 25 - the summer driver of the motorcycle Anna Mishutkina. The lost motorcyclist still had five-year-old daughter.
According to messages of mass media, the Bentley car the son of the deputy of city council of Simferopol Iosif Fayngold Vitaly operated. According to the eyewitness of an event - the girlfriend lost - the Bentley car went with a speed about 200 km/h. As a result of collision with the car the Suzuki motorcycle scattered on part, and Bentley" continued movement and crashed into two other car - "DEU" and "Gelli" which drivers got to hospital with injuries.
During the investigation dorozhno - transport incident examination established that in actions of the son of the deputy who operated the Bentley car, there was a number of violations of the rules of traffic, and car speed at the time of accident made 171 km/h.
On November 6 the Railway district court of Simferopol was sentenced by V. Fayngolda to two years of imprisonment conditionally.
The father of the lost motorcyclist Alexander Goppe submitted the appeal on this judgment.
The chief of General Directorate of Ministry of Internal Affairs in the Crimea Gennady Moskal urged the Supreme Court of Ukraine to change jurisdiction of business on road accident with participation of the son of the deputy of the Simferopol City Council Iosif Fayngold Vitaly.
