The producer of the movie "to Pomarancheva the sky", the socialist Yaroslav Mendus submitted the claim to "The Ukrainian film foundation", Katerina Yushchenko founded by Ukraine 3000 fund.
The claim is submitted to them to Podolsk regional court of Kiev in connection with violation of copyright of demonstration of the mentioned feature film on November 17-25 in Poland within the project "The Ukrainian Cinema in the World", reports a press - Socialist party service.
As declared Mendus on a press - conferences, the movie "to Pomarancheva the sky" during the specified period was shown at movie theaters of Krakow, Sopot and Warsaw.
Thus employees of "The Ukrainian film foundation" didn't get from it permission to hire, and on the contrary allegedly "received informally copies "Pomaranchevy sky" and some other the Ukrainian movies and illegally transported them through border".
"People who stood behind this swindle, not only caused to authors of the movie moral and material damage, but also put it to all Ukrainian cinema, discrediting it", - noted Mendus.
The head "Ukrainian film foundation" - private enterprise at Ukraine-3000 fund - Andrey Halpakhchi, according to Mendusya, within a month evades from communication with his lawyers and doesn't give explanations though it was twice informed on the main point.
Мендусь showed references from the Polish movie theaters that display of the movie was commercial, tickets in spite of the fact that within the project free film sessions were declared were on sale.
Producers of movies in Poland didn't get any profit on commercial hire. From hire in Poland "Yushchenko's fund appropriated money", declared Mendus.
Also it sent to Katerina Yushchenko the letter - the address in which informs on this incident and asks to take adequate measures.
Thus in the letter he notes that "all means received in the form of compensation for put losses", intends "to enclose in production of the new Ukrainian movie".
In turn, the lawyer Yaroslav Romanchuk noted that with support of the Polish lawyer Leshik Lyakhovich sent to owners of movie theaters in Warsaw, Krakow and Sopot in which the movie, the corresponding requests for conditions on which there was a movie display was shown.
Depending on received information, it and the producer will make the decision on submission of the parallel claim in Poland.
Participants a press - conferences didn't specify the claim requirements. Romanchuk only noted that the Ukrainian legislation for violation of copyright provides collecting compensation to 50 thousand minimum wages and criminal liability for a period of up to 6 years of imprisonment.
The lawyers of JSC Evrokonsalting representing interests of Mendusya, declared that process will be considered in parallel in the Ukrainian and European vessels.
