Employees the Organized Crime Control Department GUMVD of Ukraine in Kiev region carried out an inspection of the facts of violation of requirements of the current legislation by the director of one of limited liability companies concerning receiving the land plot in the territory of one of villages in the Vyshgorodsky area and violations of conditions of the investment contract on gasification of noted settlement.
During check it is established that in August, 2005 between village council and mentioned open company the investment contract by which registration and the approval of the project of land management on assignment of the land plot in long-term rent for a period of 49 years under placement of recreation facility was provided was signed and calculation of losses of agricultural grounds is approved.
In defiance of the requirement of the investment contract, for the purpose of avoidance of payment of the money added for rent of the land plot and for losses of agricultural grounds, the director of open company initiated modification process to conditions of registration of procedure of receiving the land plot by obtaining the decision and drawing up the project of land management of rather free privatization of a site under housing building.
The relevant division from land resources in June of this year provided conclusions concerning coordination of the project of land management with free assignment in a private property of the land plots for construction and service of houses in the mentioned village.
Thus, field investigators of the Organized Crime Control Department didn't allow losses of the agricultural grounds withdrawn from lands of noted village council and prevented the businessman to get the right for the land plot with a total area of 12,6 hectares illegally. It agrees ekspertno - a monetary assessment, the sum of loss of property makes 8 million hryvnias.
On this fact the prosecutor's office of the city of Kiev brought criminal case on signs of the crime provided by h. 3 Art. 15 and h. 3 Art. 190 of UK of Ukraine.
