All citizens have the right for a free access to information, the Nikolaev prosecutor's office

Cases when to citizens refuse a free access to information which concerns them, alas, aren't single. It is possible to give history that happened to the resident the citizen To as an example. which addressed in ZhKP "Breeze" for obtaining the reference on family structure.

By the management of this enterprise to it it was refused issue of the designated reference. Refusal motivated with that To. has a debt on payment for utilities. The woman didn't begin to argue, and addressed directly in prosecutor's office of the city of Nikolaev. Soon according to its complaint an inspection was carried out.

The prosecutor's office of the city handed over to the director of the enterprise the instruction with the requirement to eliminate the allowed violations of the law. By results of consideration of the instruction, a violation of the law about information eliminated. Perpetrators are brought to a disciplinary responsibility.

In this regard an example not the liyena to remind all citizens that according to Art. 5 of the Law of Ukraine "About information" the basic principles of information relations in Ukraine are established is a guarantee of the right for information; openness, availability of information and freedom of its exchange; objectivity, reliability of information; completeness and information accuracy; legality of receiving, use, distribution and information storage.

Respectively with article 9 of the same law, all citizens of Ukraine, legal entities and government bodies have the right for information which provides possibility of free receiving, uses, distributions and storages of the data necessary for them for realization by them of the rights, freedoms and legitimate interests, implementation of tasks and functions. The free access to information which concerns him personally, except the cases provided by laws of Ukraine is provided to each citizen.

According to article 10 designated above the law, the right for information is provided with an obligation of public authorities, and also bodies of local and regional government to inform on the activity and the made decisions;creation in government bodies of special information services or systems which provide in accordance with the established procedure access to information; free access of subjects of information relations to statistical data, archival, library and museum stocks; restriction of this access are predetermined only by specifics of values and special conditions of their safety that are defined by the legislation; creation of the mechanism of implementation of the right for information; implementation of the state control of observance of the legislation on information; establishment of responsibility for violation of the legislation on information.

Thus, the current legislation of Ukraine established the right of citizens for a free access to information (with certain restrictions which are set by special standards of the legislation).
