RosUkrEnergo (RUE, on 50% at "Gazprom" and the Ukrainian businessman Firtash) gave on October 22 the claim to Emfesz in arbitration court of a chamber of commerce of Stockholm, demanding from the former contractor more than $500 million
As appears from the claim, this sum includes a debt of the Hungarian trader for the gas received from RUE from September, 2008 till April, 2009, percent on this debt, and also percent for using the commodity credit for the gas put from 2005 to 2007. According to the claimant, Emfesz violated the contract with RUE on supply of gas to Hungary from 2005 to 2015 as "I didn't pay all due (RUE) of the sum for deliveries under the contract and didn't sign delivery acts - acceptance of the gas put by RUE". "Such claim exists", - the representative of RUE Andrey Knutov confirmed, having refused further comments. Didn't begin to make comments on the claim and RUE representing interests the lawyer of the Swedish company Setterwalls Jørgen Almeloew and the representative of court Christina Frantsen - Papazov.
Till January of this year the scheme of relationship of RUE and Emfesz looked so: "Gazprom" delivered RUE gas, and that is to Ukraine and the Hungarian trader selling gas in Poland and Hungary. And all these years "Gazprom" through RUE actually credited the Emfesz gas, receiving payment a year later. After gas war of Moscow and Kiev in January of this year "Gazprom" signed the direct contract with Ukraine, having ceased to deliver RUE gas. But until the end of April as the general director of Emfesz Ishtvan Gotsi admitted earlier, his company "received about 350 million cubic meters in any way not issued gas". On April 26 deliveries to the address Emfesz were stopped. And 29-guo Guoqi, having used the power of attorney issued to it a few years ago, I sold the trader for the Swiss firm Rosgas. At that time Emfesz owed RUE of $365 million. Structures of the former owner of the trader - Firtasha challenge asset sale, but while unsuccessfully.
Reciprocal objections in the claim of RUE Emfesz has to formulate till November 6, I solved the Stockholm arbitration. "It is a standard step which gives the chance to us to agree with RUE, - considers Gotsi. - There will be still time and opportunity to settle our issues with RUE. We try to solve with "Gazprom" a problem in a normal key, but, unfortunately, not all are interested in it".
The businessman from an environment Firtasha considers that Gotsi pushed RUE to the decision to submit the claim to Emfesz. In the middle of October the Hungarian trader exposed claim RUE on, 785 billion, including the missed benefit from short deliveries of gas and the requirement to make the deposit for compensation of damage till December 31, 2015 when expires the contract RUE and Emfesz. The list of claims of the Hungarian trader included also a debt of his former owner, the Cyprian Mabofi ($285,5 million). "RUE hastened to go the first to approach (having appealed to court)", - the businessman concludes.
Representatives of "Gazprom" in coordination council of RUE insisted long ago on the claim to Emfesz, notes the source close to the management of the Swiss company, but Firtash's representatives in council long pulled and agreed with it only recently. The representative of "Gazprom" refused comments.
