Yushchenko explained to the Constitutional Court that cancellation of the Ternopol elections is unconstitutional

The president Victor Yushchenko directed today representation in which asks to recognize unconstitutional the resolution of the Verkhovna Rada on cancellation of snap elections of deputies of the Ternopol regional council to the Constitutional Court.

About it reports a press - Yushchenko's service with reference to the deputy head of the presidential Secretariat - the representative of the President in the Constitutional Court Marina Stavniychuk.

On belief of the head of state, the specified decision of parliament contradicts at the same time to several standards of the Basic Law. First of all, BP has no other powers, that are fixed in the Constitution. In the main legal document of the state it is accurately specified that the parliament can appoint only the next or snap elections in local governments, but has no powers to cancel or stop them in any way. This requirement defines also impossibility of recognition lost action of the parliamentary resolution on purpose of elections.

M. Stavniychuk noted that the Constitutional Court already made an explanation concerning limits of powers of the Verkhovna Rada. The conventional international standards of democratic elections provide guarantees of implementation of electoral rights of participants of electoral process. It means that any authority can't work for the purpose of failure of elections and necessary selective procedures. The Ukrainian legislation at all doesn't provide even opportunity to stop electoral process which already began.

"The parliament consciously, exclusively from tactical reasonings and from - for fear of BYuT to test the next crushing defeat on local elections went for Constitution violation. The judgment of the Kiev district administrative court which tried to block elections in the Ternopol regional council became rough raiding. In essence, the court on - thieves' tries to deprive of people of their right to elect the power. This decision was made after the decision of the Ternopol district administrative court which obliged a territorial election commission to continue electoral process and to provide implementation of electoral rights of citizens.It is cynical mockery both at elections, and at voters".

M. Stavniychuk noted that elections in the Ternopol regional council will pass, despite of the mad resistance of BYuT which already developed campaign for failure of elections, preventing to free will of citizens. For today there are all sufficient legal grounds in order that the representative authority in Ternopolshchina was elected.
