The draft constitution introduced by the president Victor Yushchenko in parliament, suggests to propose the candidate of the prime minister of party which gathered the majority during elections in the Chamber of Deputies.
"For formation of staff of the Cabinet the president charges to the candidate for a position of the prime minister, authorized by political party which following the results of elections in the Chamber of Deputies received the greatest number of mandates, to create and submit in 20-dnevny time for consideration of deputies of the offer on staff of the Cabinet together with the program of activity of the Cabinet", - is told in the bill.
In case for 10 days after introduction of offers concerning staff of the government and the Chamber of Deputies program I didn't approve staff of the Cabinet and the program, the candidate for premieres from the second for the number of deputy mandates of party has to provide the offers on structure of the government.
In case for 10 days deputies again don't approve structure of the government and its program, according to the draft constitution, the candidate for a position of the prime minister is appointed by the president. He charges to the candidate for 30-day term to make the relevant proposals in the Chamber of Deputies.
If and in this case the Chamber of Deputies didn't approve staff of the Cabinet and the program of its activity, the president dismisses the Chamber of Deputies and appoints snap elections of People's Deputies.
According to the project, the cabinet provides and is responsible for implementation of domestic and foreign policy of the state in implementation of the Constitution of Ukraine and laws, decrees of the president.
According to the existing Constitution, the candidate of the prime minister is brought by the president according to the offer of the coalition of deputy fractions which part the majority of People's Deputies from the constitutional structure of the Verkhovna Rada is.
