"Gazprom" really notified "Naftogaz" on the fact of violation of the contract for delivery of natural gas regarding its shortage and possibility of exposure of large penalties.
Bogdan Sokolovsky reported about it authorized the president concerning energy security, reports "Interfax - Ukraine".
"According to NAK management, such letter is. I will note that legislative bases for emergence of such letter are as in gas contracts of January 19, 2009 such penalties are provided", - he told.
At the same time, Sokolovsky emphasized, application of any penalties automatically doesn't come up from the contract.
"Legal justification is, but penalties can come only after the corresponding judicial review and the judgment subsequent to it", - the representative of the president explained.
In his opinion, judicial proceedings wouldn't decorate relationship, both managing subjects, and the governments and the states as a whole.
"Therefore such disputes need to be settled it is normal and equal at a negotiating table, without waiting for vessels", - Sokolovsky told.
He hoped that emergence of such notice after negative reaction of Moscow to the declaration signed in Brussels about modernization of the gas transmission system of Ukraine isn't a blackmail element.
"I think that that atmosphere which developed in recent days in relationship between "Naftogaz" and "Gazprom", gives all grounds to say that we already passed such relations", - the representative of the president noted.
He once again emphasized that modernization of the Ukrainian gas transmission system is at least tripartite process between the supplier, the transitor and the consumer, and the Russian side will be unambiguously recruited in tenders and competitions for selection of customers, performers and financiers of separate works.
At the same time Sokolovsky noted that the specified notification of "Gazprom", a delay with signing of the technical agreement confirm once again that signed long-term Ukrainian - the Russian gas contracts demand modernization.
"For today negotiation process at the level of the companies, I consider, passes rather structurally. "Gazprom" and NAK among themselves on mutually advantageous conditions agree and there is a result: the technical agreement is signed, sanctions for a gas shortage still weren't", - he told.
"It means that there is a professional will of two managing subjects to find a common ground", - the adviser to the president emphasized.
It is known that earlier informed circles reported that "Gazprom" last week sent to "Naftogaz" the formal notice on a shortage of natural gas in the first quarter and possible penalties.
