The president Victor Yushchenko suspended permission of the Cabinet to direct charitable (voluntary) contributions and donations from legal entities and individuals on salary payment to employees of the budgetary institutions of education, health care, social protection, culture, science, sports and physical training.
About it it is spoken in the decree 287/2009 of April 30.
Thus, Yushchenko suspended separate provisions of the government resolution 368 of April 14.
The president considers that this resolution the government touched on itself powers of the Verkhovna Rada as according to part 2 of article 4 of the law "About Charity and the Charitable Organizations", the concrete directions of charity and charity are defined by philanthropists and charters of such organizations.
Yushchenko's same decree I suspended the order of the Cabinet 420 of April 14 by which it was allowed to the state and municipal healthcare institutions at the request of citizens for the corresponding payment to allocate a bed - places of the increased comfort and to provide other services.
Yushchenko explained suspension of the decree order of the government by that it violates article 49 of the Constitution according to which in the state and municipal healthcare institutions medical care is provided free of charge.
Also, according to the President, this order the Cabinet of Ministers violated article 24 the Constitutions guaranteeing to citizens the equal rights.
"The cabinet of Ukraine actually put receiving by citizens of vital medical care in dependence on their financial opportunities, than violated provisions of article 24 of the Constitution", - is told in the decree.
Yushchenko considers that this order the Cabinet of Ministers broke also some other provisions of the Constitution regarding ensuring the rights of citizens, and also legislative regulation of ensuring the rights of the population in the health care sphere.
