Yushchenko will incur in KS any date of elections, except January 17

Appointment as parliament of any date of presidential election, except January 17, 2010 it will be appealed in the Constitutional court, simultaneous early elections of the president and the Verkhovna Rada can be an exception.

It was declared by the deputy head of the secretariat - the representative of the president in the Verkhovna RadaIgor Popov.

He emphasized that the next presidential elections have to take place not earlier than not later on January 17 as it is indicated accurately by the Constitution.

"The next presidential elections are held last Sunday of the last month of the fifth year of powers of the president", - he quoted the provision of article 103 of the Basic law.

That is, Popov explained, the Constitution connects date of elections of the president with the last Sunday of the last month of its powers, instead of with calendar month.

Thus it is necessary to understand so that the term of office of the president is calculated from the moment of bringing of the oath by it to the people at ceremonial meeting of the Verkhovna Rada (part of the first article 104). "Ceremonial meeting took place on January 23, 2005", - Popov reminded.

Referring to the decision of the Constitutional Court on illegality of the parliamentary decision on elections on October 25, 2009, Popov told that the Verkhovna Rada is obliged to approve new date of the next presidential election.

Popov reported that in case of appointment as parliament another, than on January 17, dates of the next presidential elections the decision of the Verkhovna Rada will be appealed in the Constitutional court.

At the same time he assumed that the constitutional date of elections can be displaced: it can be changed in case simultaneous early elections of parliament and the head of state take place.

"The president already stated readiness for compromises with parliament on this matter. Certainly, for carrying out simultaneous elections it is necessary to adopt the special single law or to make changes to existing electoral laws, however in the presence of political will the relevant decisions can be made throughout this session I SAY LIES", - the representative of the president in parliament declared.
