The restrictions set by the legislation concerning navigation of vessels on approaches to the water area of the Nikolaev sea trade port, do impossible carrying out vessels like CH-70 (deadweight over 70 thousand tons, 227 m long, 32,4 m wide and osadky to 13 m) to JSC Nibulon mooring. Such is an official position of the Ministry of transport and communication.

Press - the service of the Ministry of transport and communication claims that swimming of trade vessels on approaches to the mooring of JSC Nibulon is carried out according to Rules of swimming and pilot carrying out vessels in North - the western part of the Black Sea, Bugsko - Dneprovsko - the Limansky channel and the Kherson sea channel, approved by the Mintranssvyaz order of 01.08.2007 No. 655, obligatory resolutions on the Nikolaev sea trade port and "Sailing directions of the Black and Azov seas on waters of Ukraine".
The sailing directions of the Black and Azov seas on waters of Ukraine declared width of the first bend of the channel of the water area of the Nikolaev sea trade port which makes 80 m. By results of an oplavyvaniye of the first bend of the channel specialists of Ukrmorrechflot, GP "The Delta — the Pilot" and "Ukrvodshlyakh", and also the pro-measured works performed on October 18, 2009 by the Nikolaev branch of public institution of "Gosgidrografiya" for definition of an actual state of depths and a profile of the channel,existence of inadmissible narrowing of width of the channel by places to 48 m and essential shift of a profile of the channel concerning its axis is established.
For ensuring safe swimming on the transitional radius of turn with 13-го Bugsko's knee - Dneprovsko - the Limansky channel on the first bend of the channel of the water area of the Nikolaev port in this zoneit is necessary to provide width and channeldepth according to technological norms of RD 31.31. 47-88.
Thus, above parameters of the channelcomplicate swimmingnot only large-tonnage vessels like CH-70, and and the vessels which sizes meet the established standards.
Confirmation to it areemergency sea events, including: grounding of the vessel "LADA 2005" of 13.12.2007 around a buoy No. 134 (a turn place from the approach channel to JSC Nibulon mooring on the first bend of the approach channel of port) after loading from JSC Nibulon mooring; grounding of the vessel "CHARLOTTE BULKER" of 5.10.2008 during movement by the eighth bend of the channel after loading from JSC Nibulon mooring.
For providing established safety requirements of navigation with the Nikolaev sea trade port on October 5, 2009dredging worksare begun on the first bend of the channel of the water area of port what it is officially declared in the coastal prevention of September No. 369/09 29.
Respectively,now any operations with large-tonnage vessels on the way to the mooring of JSC Nibulon have to be under strict supervision of the captain of the Nikolaev sea trade port. End of a complex of dredging works is plannedin March, 2010.
Under present conditions of carrying out large-tonnage vessels like CH-70 to the mooring of JSC Nibulonis unfairly risky, after all bears threat of safety of navigation and can lead to emergence of an emergency event.
Besides, the ministry is revolted that subjects of managing see in it not the guarantor of the state interests, and the arbitrator who has to protect commercial interests of one of the parties.
