Deputies overcame the veto of the President on the Law "About the Organization and an Order of Activity of the Verkhovna Rada"

People's Deputies overcame the veto of the President of Ukraine on the Law "About the Organization and an Order of Activity of the Verkhovna Rada of Ukraine".

As the correspondent of the UNIAN reports, 384 of 442 People's Deputies registered in a sessional hall voted for overcoming of the veto.

Before it deputies didn't support the proposal of the President on a rejection of this law.

For such decision voted only 33 (at necessary 226 - the UNIAN) from 442 People's Deputies registered in a sessional hall.

As reported the UNIAN, on September 4, 2008 the Verkhovna Rada overcame the veto of the President on the Law "About the Organization and an Order of Activity of the Verkhovna Rada of Ukraine". The relevant law was adopted by BP on April 8, 2008.

In the remarks the head of state noted that under the Constitution public authorities and local governments, their officials are obliged to act only on the basis, within powers and the way, provided by the Constitution and laws of Ukraine; the organization and order of activity of the Verkhovna Rada, the status of People's Deputies are defined only by laws of Ukraine.

According to the President, by the Basic Law of the state it is also provided that the operating procedure of the Verkhovna Rada is established by the Constitution of Ukraine and BP Regulations; the chairman of the Verkhovna Rada carries out the powers provided by the Constitution of Ukraine, in the order established by Regulations of BP; adoption of Regulations of BP to belong to powers of the Verkhovna Rada.

The president noted that the Constitutional Court of Ukraine, analyzing the provision of part of the fifth article 83, point of the 15th part one of article 85 of the Constitution of Ukraine in their system communication with provisions of part of the second article 6, part of the second article 19, point of 21 part one of article 92 of the Constitution of Ukraine, came to a conclusion that the Regulations which normalizes the organization and activity of the Verkhovna Rada, have to be accepted only as the law and under the Constitution of Ukraine established by articles 84, 93, 94 to procedure of its consideration, acceptance and coming into effect.

Thus, the law which defines the organization and an order of activity of the Verkhovna Rada, has to provide fixing at legislative level of points of order of its functioning, in particular an order of preparation and carrying out sessions of the Verkhovna Rada, its meetings, formations of bodies of the Verkhovna Rada, legislative procedure, procedure of consideration of other questions carried to powers of parliament, adoption of decisions by it, etc., that is to govern the public relations which arise in connection with the organization and order of activity of the Verkhovna Rada.

Instead, the President, the law which arrived to him for the signature noted, consists of two articles according to which the organization and an order of activity of BP are established by the Constitution of Ukraine, laws of Ukraine on the status of People's Deputies, on parliament committees, on temporary special and temporary commissions of inquiry of BP, other laws of Ukraine and BP Regulations. The called law comes into force from the date of its publication.

Therefore, instead of appropriate fixing at legislative level Regulations of BP of questions of activity of parliament the Verkhovna Rada adopted the law which contains only blanket norm which sends to other sources of the right and doesn't create appropriate legal base for parliament work as that is demanded by the Constitution of Ukraine.

Besides, provisions of the law which arrived for the signature, assume possibility of adoption of Regulations of BP the bylaw that doesn't answer point of 21 part one of article 92 of the Constitution of Ukraine and the decision of the Constitutional Court of Ukraine of April 1, 2008.

In this regard the President suggested to reject the law adopted by the Verkhovna Rada.

On November 27, 2009 the Constitutional Court of Ukraine recognized unconstitutional the Law "About the Organization and an Order of Activity of the Verkhovna Rada of Ukraine".
