This resolution breaks the law as it is authorized to precinct election commissions to enter changes in lists only on the basis of passport presentation without vote interruption". About it "Crime. "The resolution actually creates prerequisites for mass falsifications therefore the legal service of the Ukrainian People's Party already prepared the corresponding judicial claim", - Yury Kostenko's representative noted. It explained that adopting this resolution of the Central Election Commission exceeded the powers, in defiance of article 19 of the Constitution of Ukraine which demands that the Central Election Commission acted "only on the basis, within powers and the way provided by the Constitution of Ukraine". "In particular, according to point 20 of Art. 92 of the Constitution of Ukraine it is noted that the organization and an order of elections and referenda are defined only by laws of Ukraine", - Dmitry Popov emphasized.
According to him, "the provisions of 7.6 "Explanations" approved by the resolution of the Central Election Commission by No. 475 are essentially new legal mechanisms which haven't been provided by the current law of Ukraine "About an election of the president of Ukraine", that is directly contradict provisions of the law".
"the Central Election Commission allocated precinct election commissions with powers to make changes to electoral lists without interrupting vote, without coordination with body of maintaining the State register of voters, at presentation only the passport of the citizen that contradicts the current version of the Law of Ukraine "About an election of the president of Ukraine" and the Law of Ukraine "About the State register of voters", - the representative of the Ukrainian People's Party explained.
"Such "simplification" will allow the same voter to be registered at the same time in several places and thus there will be no practical opportunity to check the data provided by such person", - Dmitry Popov is convinced.
Summing up, the representative of the Ukrainian People's party emphasized that "UNP and will trace further all violations and legal service of party to react to them judicial claims". "The law anyway has to be carried out if we want a democratic choice, instead of jugglings of results" - were emphasized by him.
