The representative of the President of Ukraine on international issues of energy security Bogdan SOKOLOVSKY declares that JSC Gazprom still didn't withdraw the claim to the NAK Naftogaz Ukrainy, given on January 16, 2009 in Arbitration institute of the Chamber of commerce of Stockholm in connection with so-called January "gas war".
As the correspondent of the UNIAN reports, B. Sokolovsky reported about it today to journalists in Kiev.
"Till this time nobody said that the claim which gave "Gazprom" to NAK Naftogaz Ukrainy on January 16 this year concerning that problem which happened because of the Russian side, - undoubtedly, we are convinced of it, - the claim isn't withdrawn and not cancelled", - B. Sokolovsky told.
Thus he added that "arbitration production is suspended till May 31, 2010".
As reported the UNIAN, JSC Gazprom still on January 16, that is before signing on January 19 gas agreements between NAK Naftogaz Ukrainy and JSC Gazprom, I requested arbitration in Arbitration institute of the Chamber of commerce of Stockholm. Type of dispute as it is specified in a request for arbitration, - "transit of the Russian natural gas through the territory of Ukraine".
In the declared requirement "Gazprom" specified that between "Naftogaz of Ukraine" and "Gazprom" there is a long-term contract on volumes and conditions of transit of the Russian natural gas through the territory of Ukraine for the period from 2003 to 2013 and the corresponding additions to it.
According to these documents, according to "Gazprom", the respondent (NAK Naftogaz Ukrainy) not only "didn't observe legal obligations for transit of natural gas through the territory of Ukraine to Europe", but also withdrew transit gas.
In the Stockholm arbitration "Gazprom" I asked, in particular, to oblige the respondent to renew and continue execution of the obligations for rendering services of transit to the claimant according to conditions of the long-term contract.Also to recognize withdrawal of the selected gas by lasting violation of the long-term contract, to oblige the respondent to return to the claimant the selected gas (or its equivalent) and to claim the losses suffered by the claimant.
Besides, "Gazprom" sent to the Stockholm arbitration the additional letter with specification of claim requirements. The last point in it is expressed by figure in 100 thousand euros.
In turn, on March 6 "Naftogaz" asked arbitration to reject "Gazprom" request because, according to arbitration reservations to which the Russian side refers, on pre-judicial - world and mutually acceptable - settlement of dispute between NAK Naftogaz Ukrainy and JSC Gazprom is taken away 45 days "from the moment of dispute emergence", only after which in case the consent isn't reached, the appeal to arbitration is possible.
Thus "Naftogaz" emphasized that the requirements declared by "Gazprom" "are unreasonable and are absolutely rejected by "Naftogaz" on the procedural and formal bases, and also on the bases in fact". In the document also it is noted that "Naftogaz" reserves the right to submit the counterclaim against "Gazprom" in case arbitration production is continued.
We will remind, the conflict of this year as a result of which the Russian gas monopolist - the Gazprom company - since January 1 almost for three weeks stopped supply of gas to EU, became the second from the moment of declaration of independence as Ukraine.
