The president reminded of standard of the Constitution according to which about the early termination of powers of parliament consultations of the President of Ukraine with the Chairman of the Verkhovna Rada of Ukraine, his deputies and chairmen of deputy fractions in the Verkhovna Rada of Ukraine about the early termination of powers of the Verkhovna Rada of Ukraine have to precede the publication of the Decree of the President.
"I begin consultations on making decision on the early termination of powers of the Verkhovna Rada of Ukraine of the VI convocation", - the President declared.
At the beginning of performance Victor Yushchenko stated legal arguments to destination today's consultations. It reminded that on September 2, 2008 the deputy fraction of the "Our Ukraine — National Self-defense" Block made the decision on an exit from the Coalition of democratic forces in connection with impossibility of implementation of the coalition agreement. On September 3 this decision was announced by the Chairman of the Verkhovna Rada at parliament meeting.
Thereof the numerical structure of the Coalition of democratic forces in the Verkhovna Rada of Ukraine of the VI convocation decreased to number of People's Deputies smaller, than is defined by the Constitution.
The president referred to the decision of the Constitutional Court of Ukraine of September 17, 2008 No. 16-rp/2008 on the case of the coalition of deputy fractions in the Verkhovna Rada of Ukraine. According to it the requirement about the cumulative number of People's Deputies of Ukraine who as a part of deputy fractions form the coalition of deputy fractions, concerns both the moment of formation of the coalition, and the entire period of its activity.Besides, reduction of numerical structure of the coalition of deputy fractions by any way "to number of People's Deputies smaller, than it is defined by the Constitution of Ukraine, too attracts the termination of its activity from the moment of approach of such reduction".
"Thus, after reduction of numerical structure of the Coalition of democratic forces in the Verkhovna Rada of Ukraine of the VI convocation it stopped the activity", - the President stated.
After that, according to the President, within one month which has passed after disintegration of the coalition, and also in the extra time provided to them, the new coalition of deputy fractions as it is provided by article 83 of the Constitution isn't created.
"Any of political fractions of parliament till this period didn't make offers on majority formation in parliament which would be signed by more than 225 People's Deputies", - Victor Yushchenko told.
Thus, the President declared, according to point of 1 part of the second article 90 of the Constitution of Ukraine the President of Ukraine has the right ahead of schedule to stop power of the Verkhovna Rada of Ukraine if for one month in the Verkhovna Rada of Ukraine the coalition of deputy fractions according to article 83 of the Constitution isn't created.
It also made a number of legal cautions concerning constitutionality of the possible decision on purpose of early elections. In particular, as regards according to part of the fourth article 90 of the Constitution of Ukraine of power of the Verkhovna Rada of Ukraine which be chosen on the snap elections held after the early termination by the President of Ukraine of powers of the Verkhovna Rada of Ukraine of the previous convocation, can't are stopped for one year from the date of its election.
The president reminded that last year's snap elections were appointed by the Head of state the Decree of June 5, 2007 No. 497 not in connection with the early termination by the President of Ukraine of powers of the Verkhovna Rada of Ukraine.
"The president of Ukraine in June, 2007 didn't make the decision on the early termination of powers of the Verkhovna Rada of Ukraine of the V convocation. Snap elections in the Verkhovna Rada of Ukraine which took place on September 30, 2007, were appointed by the Decree of the President in connection with a nepolnomochnost of the Verkhovna Rada of Ukraine and impossibility of restoration of a polnomochnost of parliament", - the President especially emphasized.Thus, according to him, carrying out in 2007 of snap elections didn't involve the mechanism of part of the fourth article 90 of the Constitution of Ukraine which demands the termination of one-year term from election.
"For making decision on the early termination of its powers and this situation this constitutional requirement doesn't concern", - the President is convinced.
In return, participants of consultations indicated the need to bring before carrying out early elections in case they are appointed, changes in laws on the state budget (concerning financing of election campaign), and also in laws on elections of deputies of the Verkhovna Rada and on the state register of voters. It will be in such a way possible to guarantee legality of carrying out these elections and to avoid the appeal of their results in court. "If this legislation isn't accepted, I think, we will enter a train of any improbable number of judicial claims", - the Chairman of BP Arseniy Yatsenyuk predicted and appealed to other participants is consolidated to approach to this legislative work. The First Deputy Chairman of BP Alexander Lavrinovich appealed to fractions soon to give the answer to how practically to carry out these legislative changes.
"The coalition had every chance for realization. President, Prime minister, Chairman of the Verkhovna Rada, 226 voices. But, to the greatest regret, this coalition from chances turned into the coalition of the lost chances", - the speaker stated.
In the performances representatives of parliament as a whole agreed with need to hold new elections.
"Early elections were predicted. There is a right of the President, and to you to make this decision", - the chairman of PR fraction Victor Yanukovych recognized.
In turn, Ivan Kirilenko with regret confirmed that such elections неотвратимы and "if the decision will be made today, we will obey". The chairman of WELL-NANOSECOND fraction Vyacheslav Kirilenko also noted that terms of search of a consent concerning a format of the coalition are settled, thus the President acquires a constitutional law to make the decision. Vladimir Litvin warned that when carrying out new elections it is necessary to accept legislative changes concerning their honesty, and also political guarantees.
"Obviously, it is necessary to accept mutual obligations on the fact that these elections were honest that will of people wasn't distorted", - V. Litvin told.
Reasoning carrying out today's consultations, Victor Yushchenko noted that opportunities to create new or to restore the previous structure of the coalition weren't used productively from - for positions of parliamentary forces.
"There are specific people who are responsible for that happened on September 2 in the Ukrainian parliament. This treachery of democracy, this treachery of ideals, but you thought that you will make two coalitions - for people you will leave one with "our Ukraine", and you will do another to make decisions on your prospect of the next 5-10 years. So doesn't happen. It is necessary to sit on one chair and to care of one values", - the President told. It noted that in such situation democratic values are threatened and there is an unknown split among democratic political forces.
The head of state explained that the constitutional norms of rather early elections gained relevance.
"You present me with a fait accompli lack of the coalition. The parliament without the coalition is impractical. You didn't take enough steps to recreate either the new coalition, or the conceived coalition, or the devoted coalition. The president isn't the subject of negotiations, but I did everything in order that this dialogue was continued", - Victor Yushchenko told.
In that case, according to the President, "The constitution demands to work further and to look for the answer in other mechanism - not less democratic: in early elections".
"Or you give that scenario which can give the answer alternative, or if isn't present, let's structurally speak about the second democratic step - early elections", - the President told.
Summarizing a today's meeting, the Head of state gave to the Verkhovna Rada time for the solution of the questions, necessary to settle parliament work.
"I give you this time. It is important that after today's consultations it was created in parliament, obviously, from leaders of parliamentary fractions, an initiative of the solution of those questions which should be carried out in parliament for an exit from a stalemate. Forward run, run back, but give offers as we will suit further an exit from an impasse", - the President offered.
Separately he warned against that in search of an exit from a political situation to use such arguments as need of overcoming of consequences for Ukraine world financial crisis.
"Demagogy round financial crisis, world crisis, a mortgage meltdown, share crisis - don't gather these mere words to strain an internal situation in Ukraine", - he warned. According to the President, the most important call in the Ukrainian economy - high rates of inflation which were caused by populist unreasoned policy in the first quarter of this year. Victor Yushchenko emphasized that for adoption of anti-recessionary economic decisions it is necessary to depart from policy as much as possible.
After that the President of Ukraine Victor Yushchenko left with official visit to the Republic of Italy. Visit will take place by the invitation of the President of Italy Giorgio Napolitano.
It is planned that on October 8 the President will hold meetings with the highest officials of Italy - the President Giorgio Napolitano, the Chairman of the board Ministrov Silvio Berlusconi, the Chairman of the Senate of Renat Giuseppe Skifani, the Chairman of the Chamber of Deputies of Parliament Gianfranco Fini.
During negotiations the Head of state intends to discuss a question of support of the European and euroatlantic course of Ukraine by Italy. Ukraine - EU in Paris is a question, in particular, of the invitation of Ukraine to PDCh at December meeting of Ministers of Foreign Affairs of NATO member states and realization of political arrangements of the last Summit.
It is planned that by results of negotiations the Agreement between Ukrainian and Italian the governments about cooperation in the field of tourism will be signed.
The president of Ukraine also will state a number of offers on implementation of large-scale investment projects, in particular within preparation of Ukraine for EURO-2012.
