The president of Ukraine Petro Poroshenko signed the Law «About clarification of the power» , accepted by the Verkhovna Rada on September 16.
Reported about it in a press - service of the head of state.
The law defines legal and organizational bases of carrying out check of public servants and the persons equated to them, officials of local governments «for the purpose of restoration of trust to the power and creations of conditions for creation of new system of authorities according to the European standards».
Subjects of check according to the project the President, the Chairman of BP and it are deputies, members of Cabinet of Ministers, the Public prosecutor, Chairmen of SBU and NBU, the ombudsman, People's Deputies, public servants and officials of local governments, military officials, judges (including judges of KSU), members of VKKS and VSYU, members of the CEC, a face of the private and the commanding structure of Department of Internal Affairs, tax police, etc., and also persons who apply for occupation of the above positions.
Data are subject to check:
- specified in the declaration on property, the income, expenses and obligations of financial character;
- involvement of the person to criminal liability;
- existence of administrative penalties for corruption offenses.
If the person applies for one of positions which demand carrying out on it the corresponding check, won't agree on it, check on it isn't seated and its candidacy isn't considered.
The conclusion about results of check aren't confidential information if it doesn't contain information which is the state secret.
The conclusion about results of check of judges of the general jurisdiction which contains data of that the person doesn't conform to the requirements established by the legislation for further stay to positions of the judge goes to the Supreme council of justice, the Highest qualification commission of judges.
Subjects of check who refused its passing, or not passed it, pass certification according to the Law on clarification of the power and are subject to dismissal with deprivation of the right to hold the positions stated in the list above within 10 years from the date of dismissal.
The same concerns persons who left from the corresponding positions before coming into effect of the Law on clarification of the power and refused to undergo testing.
We will note that earlier President Petro Poroshenko I promised that will sign law on lustration.
We will remind, on September 16 the Verkhovna Rada Ukraine from the fifth attempt I accepted in the second reading and in general bill No. 4359a «About clarification of the power» (about lustration). «For» the law voted 231 People's Deputies.
