Seven employees of prosecutor's office of the Nikolaev area accused the prosecutor of the Nikolaev area Vyacheslav Krivovyaz of selective approach to reduction of the staff of department and are revolted that works lose people with an extensive experience of work and advantage before those who remains.
I there was a speech about it during a meeting of the advisory board at prosecutor's office of the Nikolaev area on Wednesday, August 26.
The day before addresses from seven employees of prosecutor's office the majority from which have more than 15 years of length of service with a request came to council to help them to achieve justice. It is that in prosecutor's office of area within the carried-out restructuring was removed for the staff of 77 people. 55 from them it was taken back in staff in the reformatted departments, and 22–will be soon dismissed. Among them there were employees who, according to the legislation on work, have a number of the privileges giving them advantage before the colleagues. In particular, under reduction the prosecutor Anatoly Titus, famous in Nikolaev, at which 20 years of an experience, the status of the participant of military operations in Afghanistan, encouragement for good service, a number of the opened resonant affairs got: so-called «vradiyevsky business» , case of murder «speculators in foreign currency» and so forth
Also under reductions Irina Boeva, the senior prosecutor of department of representation of interests of citizens and the state in courts, Dmitry Pletenev, the prosecutor of department of statistics, maintaining the Unified register of pre-judicial investigations, Zoya Gulyaeva, the senior prosecutor of department of supervision behind observance of laws in bodies of tax police, Vadim Brezitsky, the senior prosecutor of department of representation of interests of citizens and the state in courts, Olga Levitskaya, the senior prosecutor concerning access to public information got. All of them received the notice of layoff a month ago, and they still had one more month after which they will remain without work.I acted as well Natalya Danilyuk who held a position of the head of department of statistics, maintaining the Unified register of pre-judicial investigations who the day before under pressure of the prosecutor of the region wrote the letter of resignation.
According to them, the commission which made the decision on their dismissal, didn't take into consideration any of factors which spoke well for the dismissed: it both an experience, and merits, both encouragement, and the juvenile children who are available on the contents at some of the dismissed.
- It was necessary to take 77 cases. Conditionally speaking, there are 55 places. And according to the law «About work» , article 42 to consider requirements of the law concerning what workers have more advantages. Because in prosecutor's office the law first of all has to work. And despite the fact that, I, according to part 1 of article 42 of the law «About work» , I have big advantages, I have more experience, there is an award from the Public prosecutor, and other advantages. However didn't offer me, as well as those who is in this hall, any of positions of these 55. And a similar situation at most of those who directed the appeals to the advisory board. The dismissed prosecutors ask one–to make the commission fair solution. They are ready to challenge orders of the prosecutor of the region on their dismissal in court and are sure that the law on their party. However still hope that the situation can resolve fairly.
The second problem about which the staff of prosecutor's office spoke–this reforming of department which was carried out without proposals of employees that as a result developed into threat of stability of work of the certain directions. According to Levitskaya, the State Office of Public Prosecutor agreed on the plan of reforming of regional prosecutor's office provided by Vyacheslav Krivovyaz. The staff of prosecutor's office provided the last the vision of changes, however they weren't considered.
In particular, according to the head of department of statistics, maintaining the Unified register of pre-judicial investigations of prosecutor's office of the Nikolaev area Natalya Danilyuk, earlier in her department six people worked: three prosecutors, head of department and two experts. After reforming remained only two: chief and prosecutor of department. And it threatens objectivity of data.
- If not to control it, the report will be biased.Crime rate can be lower or higher from what will be specified in the report. I communicated with colleagues from other areas. They also had personnel changes, but such deplorable state as at us, isn't present anywhere. Probably, experts aren't necessary here, - noted Danilyuk.
Also, the similar situation developed and with access to public information. According to Olga Levitskaya who held a position of the senior prosecutor concerning access to public information earlier, at the moment its duties were transferred to department of the organization of a reception of citizens, consideration of addresses and inquiries.
- However at the moment there are no provisions concerning consideration of inquiries. The prosecutor of the region had to define the manager of information. Until anybody, except him has no right to sign replies to the requests of public information. However at the moment there is neither structure of department, nor the provision on its work, the order isn't present. The head of department Tatyana Holodova has no right to sign answers. Moreover, she for a month went on leave, and Vyacheslav Krivovyaz for two weeks. As there will be a process of providing information on inquiry, unclear. And this with the fact that prosecutor's office of the Nikolaev area 4-I in Ukraine by amount of the sent inquiries, - Levitskaya in the comment told «Crime. Is NOT PRESENT».
Unfortunately, part in a meeting of council wasn't taken by Vyacheslav Krivovyaz who was notified on date of council and in advance on questions which on it will be discussed. This day it began two-week holiday.
As a result, the advisory board made the decision to appeal to the prosecutor of the Nikolaev area Vyacheslav Krivovyaz as soon as possible to meet members of council and the dismissed prosecutors to explain the position, and also to make fair selection of those who will be dismissed within reforming of prosecutor's office.
Meanwhile, at Krivovyaz's guide still there are unsolved many crimes committed in the period of Euromaidan against supporters of Revolution of Advantage. Though the State Office of Public Prosecutor defined investigation of these crimes as the priority direction, and Shokin promised to dismiss regional prosecutors for absence of results in this direction.
In particular, earlier it was reported, how in Nikolaev the pro-Russian separatists crushed the trolleybus, but why - that the departments headed by Vitaly Goncharov and Vyacheslav Krivovyaz still couldn't find and punish guilty though the militia and was present at incident.
Besides it it isn't known of investigation of blocking of military unit of paratroopers on Geroyev Stalingrad Avenue and blocking of the movement military equipment in Varvarovk's residential district, about investigation of cruel beating of the guy by group of young people with sticks on crossing of streets Admiral's and Civil, which they accepted for «the Banderovite from Lviv» .
Also still the public doesn't know how criminal cases move ahead on the facts of falsification of elections of 2012 in the scandalous district No. 132. High-profile cases about corruption actions passed into long lawsuits. On - former resonant murders of last years (businessmen aren't solved Anton Zubatin and Anatoly Batalov ).
In addition, at the moment remain not investigated the majority of the facts of preventing by the lawful journalist of activity. In particular, it is about attack of fighters «National militia» on journalist Alexander Vlashchenko in the building of the Nikolaev RSA, about attack representative of Radical party Oleg Malchivsky on the journalist Katerina Vovchenko, about preventing of activity to journalists Andrey Lokhmatov and Anatoly Chubachenko.
