Pasenyuk's first deputy appointed himself the acting head of VASU

The first deputy chairman of the Supreme administrative court of Ukraine Alexander PASENYUK (whose 5 - the summer term of a tenure officially expired on December 22) Nikolay SIROSH appointed today himself the acting head of VASU, having issued the relevant order.

As appears from the document copy which has at the order of the UNIAN, thus N. SIROSh cancelled No. 502-order A.PASENYuKA to of 21.12.2009 which the last appointed itself(himself) the acting chairman of VASU before appointment of the new head of court.

In motivation part of the order of N. SIROSh it is specified that according to h. 5 Art. 20 of the Law "About Judicial System of Ukraine" the presiding judge, the vice-chairman of court are appointed to a position for a period of five years.

Thus, the term of stay of PASENYuKA A is noted in N. SIROSh's order, ". The m as the chairman of the Supreme administrative court of Ukraine expired on December 22, 2009".

At the same time, as they say further, h. 5 Art. 41 of the above-mentioned law are provided that in case of absence of the chairman of the supreme specialized court its duties are fulfilled by the first deputy, and in his absence - one of vice-chairmen of this court, according to distribution of duties. "Other order of assignment of duties of the chairman of the supreme specialized court, including according to the decision of presidium of court, by the law it isn't provided", - N. SIROSh notes in the document.

Proceeding from stated, N. SIROSh ordered: "1. I start fulfillment of duties of the chairman of the Supreme administrative court of Ukraine since December 23, 2009. 2. To management of documentary providing to bring this order to the attention of judges and the chief of staff of the Supreme administrative court of Ukraine".
