The vice-chairman of Security service of Ukraine Nikolay Gerasimenko notes need of modification in Criminally - the procedural code for complete examination in court of criminal case about genocide of the Ukrainian people 1932-33.
He reported about it on a press - conferences.
"The current Ukrainian criminal legislation isn't ready to consideration of such difficult category of affairs", - he told.
In particular, Gerasimenko noted that people who already aren't present in live (organizers of the Holodomor), and under present laws if criminal case against the person who isn't present in live is brought on this case are accused, at his investigation all circumstances of a crime are established, but the official sentence as a result isn't pronounced.
The deputy chairman of SBU also noted that at present the intelligence service prepares the relevant bills which will provide in particular creation at the Supreme Court of body for consideration of criminal cases against mankind.
Also changes in Criminally - the procedural code, providing prepare that the court by hearing of cases on which accused already isn't present in live, will close not simply business, and to give them a certain legal assessment.
Besides, Gerasimenko emphasized that the SBU is on a closing stage of a legal investigation of genocide and after carrying out a number of examinations it will be transferred to Appellate court of Kiev.
During the investigation of business as the deputy chairman of SBU noted, the staff of service found and declassified 400 documents of the SBU Branch state archive and about 350 documents of bodies of the Soviet power and Communist party according to which deliberate creation by the Soviet power of hunger is confirmed.
On May 22 the SBU brought criminal case as regards 1 article 442 of the Criminal code upon genocide of the Ukrainian people in 1932-1933.
