The head department of the Ministry of Internal Affairs of Ukraine in the Crimea declares that the chairman of the Verkhovna Rada of the Autonomous Republic of Crimea Anatoly GRITSENKO is the public person and it can be criticized.
So a press - the service of the Department of the Ministry of Internal Affairs reacted to the statement of the head of the Crimean parliament for intention to file a lawsuit claims against the chief of militia of an autonomy Gennady MOSKAL from - for statements in his address.
In the statement of militia distributed today it is said that plenum of the Supreme Court of Ukraine in February, 2009 in the resolution "About Jurisprudence on Cases of Protection of Advantage and Honour of the Natural Person, and also Business Reputation of the Natural and Legal Entity" noted that at distribution of unreliable information of rather private life of public persons of the solution of affairs on protection of their advantage, honor or business reputation have the features.
So, courts have to consider the provision of the Declaration on freedom of political debate in mass media, and also recommendations of the resolution of Parliamentary Assembly of the Council of Europe about the right for personal privacy.
In the resolution it is noted that public figures are persons who hold the state positions and (or) those who plays a part in public life - in branch of policy use state resources, and also, economy, arts, the social sphere, sports or in any other branch.
"In articles 3, 4, 6 of the declaration it is specified that as politicians and officials who hold public positions or carry out the public power at local, regional, national or international levels, decided to appeal to trust of the public and agreed "to expose" itself for public political discussion, they are subject to careful public control and can potentially test sharp and strong public criticism in mass media how they carried out or carry out the functions. Thus figures and persons shouldn't have bigger protection of the reputation and other rights in comparison with other persons", - is spoken in the message of the Department of the Ministry of Internal Affairs in the Crimea.
In this regard, noted in militias, a limit of admissible criticism of the politician or other public person "is much wider, than the certain ordinary personality". The public persons "inevitably open for captious illumination of their words and acts and have to realize it", consider in the Crimean Central board of the Ministry of Internal Affairs.
