GPU protested the resolution of Cabinet of Ministers on gas-distributing networks

The general prosecutor Alexander Medvedko imposed a protest on the Cabinet No. 775 resolution of June 10 in which the state gas-distributing networks of 43 regional gas supplying companies (regional gases) are transferred to balance of Neftegazseti subsidiary.

The representative of justice reported about it during court session in the claim of the gas supplying company "Vinnitsagaz" to Cabinet of Ministers.

The protest of the State Office of Public Prosecutor was imposed on December 18. The government received a protest on December 21.

According to procedure, the Cabinet of Ministers within 10 days considers a protest of the State Office of Public Prosecutor and directs the answer: either cancels the resolution, or upholds it.

In case of disagreement of Cabinet of Ministers with a protest the State Office of Public Prosecutor has the right to appeal to court for recognition illegal the statutory act of the government.

The district administrative court of Kiev postponed on December 24 to January 12, 2010 consideration of the case on the claim of "Vinnitsagaz", "Dnepropetrovskgaz" and "Nikolayevgaz" about recognition invalid resolutions No. 775.

Consideration was postponed according to the petition of the representative of Cabinet of Ministers for additional acquaintance with case papers.

Before "Vinnitsagaz", "Dnepropetrovskgaz" and "Nikolayevgaz" appealed to District administrative court of Kiev with the requirement to nullify the resolution of Cabinet of Ministers No. 775. This resolution Cabinet of Ministers I decided to transfer the gas-distributing networks of 43 regional gases which are in property of the state, to balance of one of "Neftegaz" subsidiaries. For this purpose NAK created "Neftegazseti's" recreation center.
