The Kiev economic court recognized illegal conditions of transit of the Russian gas in 2009, the correspondent of RBC - Ukraine reports.
The judge Larisa Ivanova presided over meeting. Hearing of the claim of Ministry of Fuel and Energy took place without representative of "Gazprom".
We will remind, on January 5 the Economic court of Kiev took out the resolution with which forbade "Naftogaz of Ukraine" to carry out in 2009 transit of the Russian natural gas through the territory of Ukraine at the price of 1,6 dollars for 1 thousand CBM on 100 km. The relevant resolution was taken out in the claim of Ministry of Fuel and Energy of Ukraine, asking to recognize invalid agreements on transit of the Russian gas. These agreements provide transit of the Russian gas across the territory of Ukraine until the end of 2010
As reported RBC in a press - service of Ministry of Fuel and Energy, the basis of recognition of these agreements invalid is that agreements were concluded by the being vice-chairman of board of the Naftogaz of Ukraine company Igor Voronin who had on it no appropriate authority from the cabinet of Ukraine.
The official representative of "Gazprom" Sergey Kupriyanov declared that the statement of "Naftogaz of Ukraine" that "Gazprom" allegedly has no contract on transit, isn't true. "The contract is, it works and there is the corresponding legal conclusion", - S. Kupriyanov told. This information was confirmed today also by the head of gas holding Alexey Miller, having noted that "Gazprom" carried out the corresponding expertize according to which results the contract works till 2010
"Gazprom" made on January 3, 2009 the decision to submit to the international arbitration court of Stockholm the claim to NAK Naftogaz Ukrainy with the requirement to oblige the Ukrainian company to provide free transit of the Russian gas to Europe on the territory of Ukraine. The claim will be submitted according to the contract of June 21, 2002 about volumes and conditions of transit of the Russian natural gas on the territory of Ukraine to the European consumers in 2003-2013. Within this claim "Gazprom" asks court to take in the shortest terms the interim measures forbidding to "Naftogaz of Ukraine" to accept any actions, directed on reduction of transit of the Russian gas to Europe, it is noted in the statement.
On the same day, on January 3, 2009, the RosUkrEnergo (RUE) AG company submitted two claims to NAK Naftogaz Ukrainy to Arbitration institute of the Chamber of commerce of Stockholm. The first claim - about collection of debt of 614 million dollars for the put natural gas, the second - with the requirement to oblige to provide NAK Naftogaz Ukrainy transit of natural gas for export deliveries under the relevant contracts. Such solution of RUE made "for ensuring interests of the European consumers of gas and coercion of NAK Naftogaz Ukrainy to fulfill the contractual obligations".
